Terms and conditions for Accommodation Establishments - Bookings :

Accommodation establishments choosing to opt for our reservation system are required to pay commission on all reservations resulting from an introduction made through our websites. The sale of the accommodation is a contract between the accommodation establishment (Host) and the party seeking accommodation (Guest). A. Conolly trading as StayHere.co.za through the websites www.deadduck.co.za , www.stayhere.co.za and www.2010westerncapeaccommodation.com is the facilitator of any such contract between the Host and the Guest.

RESERVATION COMMISSION

The Host agrees to pay commission to A. Conolly at the rate of 16% (minimum charge R57.00) on the total value of all reservations, irrespective of the percentage or value of deposit collected, which reservation results from an introduction by StayHere.co.za. Commission will be due whether finalised on the website or not. In this regard the Host agrees not to conclude any reservation arrangements with potential guests introduced by A. Conolly trading as StayHere.co.za privately. Commission charged includes the facilitation of deposit payment and the transfer of funds into the Host's account. It also includes all instances where the guest pays the full tariff to the host. In which case the host will pay the commission due to A. Conolly directly to A. Conolly. In the event that the host requires A. Conolly to collect more than the standard deposit of 50% then A. Conolly will be entitled to deduct a further 2.5% of the total value as a handling fee.

RESERVATION ENQUIRIES

Potential guests wishing to make a reservation will in the first instance either complete an availability request from the web page of the establishment of their choice or enquire by telephone to the advertised telephone numbers of StayHere.co.za. The Host will immediately be contacted by SMS, e-mail or telephone. The Host must then respond with an offer which includes, the dates the accommodation is available; the total amount due for the stay; the deposit required; terms of cancellation; and how long the offer will remain valid for acceptance by the potential guest - usually within forty-eight hours. The Host agrees to respond to email messages from StayHere.co.za, promptly. Time is of the essence. A prompt reply is more likely to result in a confirmed reservation than a delayed reply. The Host's response to an availability request amounts to a legal offer, whether in writing or verbally, and may not be canceled by the Host until the time allowed for acceptance has lapsed or the offer has been accepted by the Guest. During this time the Host undertakes not to sell the accommodation to another party. This amounts to breach of contract and could lead to double booking of the accommodation. In the event of a double booking or cancellation, then the Host will be responsible for compensating the Guest for any loss as well as being liable for commission on the reservation.

COST OF ACCOMMODATION

It is the host's resposibility to ensure that the correct tariff is advertised on the web sites at all times and for all seasons. The host must allow at least ten days for any alteration to be published to the web site. Tariffs quoted should be comprehensive and should include commission. Notwithstanding any changes to the tariff the host is obliged to quote the correct tariff at all times.

RESERVATION CONFIRMATION AND PAYMENT

Payment of a deposit by the Guest, by means of secure transfer, into the account of A. Conolly, is confirmation of a contract between the Host and Guest and A. Conolly as the Facilitator. The Guest will be entitled to the agreed accommodation; the Host will be entitled to payment and the Facilitator will be entitled to its commission payable by the Host. The Host shall not be entitled to cancell the booking except in the case of natural disaster such as fire, flood, or earthquake; in which case the guest will be refunded the deposit in full by the Host. The deposit is paid by the Guest into the bank account of A. Conolly, and upon clearance by the bank, deposited into the Host's bank account by Internet transfer. (less any Commission due to the Facilitator) Cancellation of the booking by the Host for any other reason shall be deemed breach of contract.

PAYMENT POLICY

A 50% non-refundable deposit is payable by the guest on confirmation of the reservation and the balance is payable by the Guest to the Host on arrival at the accommodation establishment. It is the responsibility of the Host to collect the balance of the deposit owing by the Guest to the Host. Should the Host require A. Conolly to collect the full payment then an additional 5% commission calculated on 50% of the tarrif will be payable by the Host to A. Conolly to cover the cost of additional credit card charges.
A 16% non-refundable commission of the total value of the accommodation reserved will be deducted from the deposit received and the balance will be paid into the bank account of the accommodation establishment where the reservation was made; provided there are no other outstanding funds owing by the accommodation establishment to A. Conolly; in which case, said outstanding funds may be deducted from the deposit until the said amount has been paid in full.
Payments by A. Conolly to the host are made within seven working days of receipt of the funds.
All cancellation refunds in excess of the initial 50% deposit are made at the sole discretion of the Host and refund requests should be directed in writing to the Host concerned.

TERMINATION

This contract may be terminated by either party giving the other party forty-eight hours notice in writing, of intention to terminate.
